Conditions of sale
These terms and conditions ('Terms of Sale') bind the natural or legal person who makes a reservation ('You / Your / Yours') and the temporary accommodation service provider that you have reserved (the 'Establishment' ) whose name appears above ('We/Our/Ours').
These Conditions of Sale concern the provision of temporary accommodation (the 'Reservation') for the Establishment whose name appears on the confirmation page of Your online Reservation, and in your confirmation email (the 'Confirmation' ). These Conditions of Sale are subject to the competent courts under the conditions of common law, and apply exclusively to all Reservations made in Our Establishment.
By making a Booking You agree to be bound by these Terms of Sale and confirm that you are over eighteen (18) years of age and have the legal capacity to make Your Booking.
Reservations
Your Reservation establishes a Contract between You and Us and will be considered final when you have received our confirmation and when we have either (i) collected the total value of the Reservation, or (ii) collected a deposit of an amount less than the total value of the Reservation as specified at the time of the Reservation or (iii) been able to guarantee Your Reservation by pre-authorizing a credit card for an amount equal to the minimum cancellation fee penalties stipulated on Your Confirmation.
If the amount debited when the Reservation is taken is less than the total value of the Reservation, any remaining balance must be paid either at the time of Your arrival (check-in), or at the time of Your departure (check-out) or under the form of deposit(s) withdrawn on the dates stipulated in Your Confirmation.
When Your Reservation is confirmed, a Reservation number is sent to You by telephone, online or in Your Confirmation. This Reservation number is required if You wish to be able to cancel or modify Your Reservation at a later date and a necessary reference in all Your communications with Us. Subject to the cancellation conditions stipulated in Your Confirmation, You do not benefit from any right of withdrawal.
Prices
The price of the Reservation is based on the number of nights and the dates specified in Your Confirmation. Any additional product or service selected when booking may also be included in the total price of the Booking.
The total price of the Reservation is expressed in the currency indicated on Your Confirmation and on the screen at the time of payment and includes all taxes applicable on the date of the Reservation, including without limitation VAT, sales taxes, and local or special taxes detailed on your Confirmation. These taxes remain subject to change depending on the legislation in force (insofar as this change in legislation was not in the public domain at the time the reservation was made).
If you have selected additional services at the time of Booking, these may, where applicable and as indicated in Your Confirmation, be included in the total price of the Booking. The total price displayed and paid online does not include any additional charges or costs that You may incur during Your Stay.
Pricing Error
In the event of a pricing error, We will inform You of such error as soon as possible and, if applicable, We will immediately refund You all payments We have collected for this Booking. You agree that We shall not be liable for any other expenses incurred by You as a result of such error.
Availablity
In the very rare event that We are unable to provide You with temporary accommodation corresponding to the description and conditions mentioned in Your Confirmation, We will offer You alternative services.
Arrivals and departures
Arrival (check-in) and departure (check-out) times are specified in Your Confirmation. If You wish to arrive outside the times indicated in Your Confirmation, please contact Us directly to reconfirm Your arrival time. If Your arrival time exceeds the arrival time limit stipulated on Your Confirmation, and this without prior agreement with Us, We have the right to cancel Your Reservation for the entire stay and to demand payment of the penalties for cancellation stipulated in Your Confirmation.
Modification and Cancellation
If you modify Your Reservation and the dates ('Modification') the rates are subject to change.
The cancellation conditions are indicated in the 'Cancellation conditions' section on the booking page of Our site and on Your Confirmation.
If necessary, You can cancel Your Reservation online directly by clicking on the link provided for this purpose in Your Confirmation. For any other changes to Your Booking please contact us using the contact details displayed in Your Confirmation.
IF You cancel Your Booking before the cancellation deadline ('Date Limite'), any prepaid amount will be refunded to You upon request.
If you cancel Your Reservation after the Cancellation Deadline, all cancellation penalties specified on Your Confirmation, including, if applicable, any additional products or services covered by prepayment, will be refunded to You, and We will no longer be obligated to hold accommodation for You.
Your no-show beyond the scheduled arrival time limit will be considered a complete cancellation of Your Reservation for the entire stay and We will not be responsible for ensuring that the temporary accommodation selected remains available on the dates requested.
If You request a Change which We are unable to accommodate, Your Booking may be cancelled. If the cancellation takes place after the Deadline specified on Your Confirmation it may be subject to the late cancellation penalties specified on the Confirmation.
Payments
All Reservations must be guaranteed by means of a valid credit card or other method of payment accepted online when the reservation is taken.
Any deposit payable when making the reservation will be debited at the time of the Reservation. Your Reservation may be canceled automatically if Your Bank declines Your gold card if there are insufficient funds in Your account when it is pre-authorised.
Any deposit payable after the reservation has been taken but before arrival will be debited in accordance with the dates and payment rules detailed on Your Confirmation. Any remaining balance will be invoiced and debited on site, before Your departure, including any additional product or service consumed during Your stay.
PLEASE NOTE - Your credit card details are processed in accordance with PCI-DSS/3DSecure security standards in order to be able to guarantee Your Reservation by pre-authorizing Your credit card and in order to allow the collection of any deposit or late cancellation penalty, the where applicable, up to the total value of the Reservation and in accordance with the payment rules detailed on Your Confirmation.
If your credit card has been charged before arrival, any charge thus debited will be deducted from the final balance.
If your credit card has been pre-authorized before arrival, either we will debit the pre-authorized amount at your departure (check-out), or we will cancel the pre-authorization first before debiting your card with another amount. A pre-authorization is NOT a charge and no amount is debited from your account, but Your bank may still choose to reduce the available credit limit on your bank card as they consider a pre-authorization as a future expense commitment. This is why we make sure to cancel any pre-authorization if the amount is not debited when you leave.
Responsibility
We do our best to describe the type of accommodation offered, the location of Our Establishment, its level of comfort and its main characteristics, but We are not able to assure You that Our services meet Your expectations in any way. whether it be. If You have any questions regarding Our services, the situation of the accommodation, safety or hygiene, We invite You to contact Us directly BEFORE the Cancellation Deadline and We will do Our best to answer them.
We cannot be held liable to You for the non-performance of any of the obligations incumbent on Us hereunder, which would not be Our fault (fraud, misrepresentation, etc.), or which would be consecutive to the occurrence of a case of force majeure. In any event, Our liability shall not exceed the amount We have collected for Your Booking.
We endeavor to exercise all care and diligence reasonably necessary for the proper performance of Our obligations. We shall not be liable for any consequential damages (including loss of profit, loss of revenue, loss of money, loss of time, missed opportunities, or any other wrong or damage) that is not directly caused by Us) or that We could not reasonably foresee. We recommend that You take out appropriate travel insurance cover.
You are responsible for any damage, loss or harm suffered by Our establishment as a result of fault (acts or omissions) or negligence on Your part. In this case, You agree to pay Us directly any amount reasonably necessary to repair such damages caused by You. We reserve the right to cancel Your Reservation immediately and without reimbursement, in the event that Your behavior during the stay ceases to be reasonable and/or results in serious complaints from the staff of Our Establishment.
Protection of personal data
It is reminded that the personal data concerning You are necessary for the processing of Your Reservations. This information is recorded in Our system and transmitted to Our Service Providers who handle the processing of Your Reservation.
The transmission of Your personal data to Our service providers is intended for the sole purpose of allowing Us and our Service Providers to process Your Reservation. If necessary, Our company and Our Service Providers may transmit your data within their group, in all the countries where they may operate.
We may also be required to transmit Your personal data including without limitation your identity, your residence, telephone number, your e-mail address and your bank details to the police, or to other competent authorities, when the law and the regulations in force require it, and on the basis of a legitimate request.
The following safeguards have been taken by Us and by our service providers (including eviivo Limited) to ensure a sufficient level of protection for Your personal data: (i) Your personal data is used for the sole purpose of being able to process Your Reservation. (ii) any entity or service provider required to process your data outside the European Union must offer an adequate level of protection governed by the standard contractual clauses established by the European Commission in accordance with the General Data Protection Regulations ( GDPR).

By placing a reservation on Our Site you consent to the processing of your personal data as described in the clauses set out above, including their transmission to our service providers. You have a right of permanent access, rectification and opposition with regard to information concerning You. To exercise this right, You must send Us a letter to the address indicated on Your Confirmation.
